The Highway Code is made up of the rules of safe driving. Some of it will be Law. You will know this because it will say MUST or MUST NOT. The rest is advice. The advice while it is not law itself can be used in a court of law. Bottom line is do what it says in The Highway Code.
An important point from The Highway Code is there is no right of way in any circumstance. Only an obligation to give way. And you should always give way to avoid an accident. See page 34 for the advice in full.
